We approve the uncontested referee’s report and place respondent on probation to be concurrent with the period of probation ordered in The Florida Bar v. Henry John Martocci, Case No. SC04-581 (Fla. Jan. 27, 2005), under the terms and conditions set forth in the report and consent judgment, effective immediately.

Further, the respondent is directed to comply with all other terms and conditions in the instant referee’s report and consent judgment.

Judgment is entered for The Florida Bar, 651 East Jefferson Street, Tallahassee, Florida 32399-2300, for recovery of costs from Henry John Martocci in the amount of $2,871.67, for which sum let execution issue.

Not final until time expires to file motion for rehearing, and if filed, determined. The filing of a motion for rehearing shallnot alter the effective date of this probation.
