On August 16, 2006, the Court issued an Order to Show Cause commanding respondent Jack S. Kaplan to show cause, if there be any, why he should not be held in contempt of this Court for failure to pay the $6,000.00 monetary penalty assessed in this Court’s order dated July 22, 2005.

Respondent Jack S. Kaplan’s Motion to Dismiss Clerk’s Command to Show Cause or in the Alternative, Motion to Stay Order to Show Cause, Motion for Order Declaring the Rules Regulating the Florida Bar Unconstitutional, Motion for Evidentiary Hearing and Motion for Restraining Order, filed with this Court on September 18, 2006, are hereby denied because the motions are without merit.

Respondent Jack S. Kaplan’s Motion to Dissolve Order to Show Cause, filed with this Court on October 4, 2006, is hereby granted. Respondent Jack S. Kaplan has paid the $6,000.00 monetary penalty and is therefore not in contempt of this Court for failure to comply with that provision of this Court’s order dated July 22, 2005.
