Having reviewed petitioner’s response to this Court’s order to show cause dated March 13, 2003, this Court hereby amends it previous order dated January 31, 2003, to make clear that this case is a discretionary review proceeding from the decision of the Third District Court of Appeal in Sibley v. Spears, 3D02-3143 (Fla. 3d DCA Nov. 22, 2002), and not a discretionary review proceeding from the decision of the Third District in Sibley v. Sibley, 833 So.2d 847 (Fla. 3d DCA 2002), and hereby changes the style of this case back to Montgomery Blair Sibley v. Lois Spears, Director, Miami-Dade County Department of Corrections and Rehabilitation, and Barbara Sibley. Having determined that this Court is without jurisdiction to review the decision of the Third District Court of Appeal in Sibley v. Spears, 3D02-3143 (Fla. 3d DCA Nov. 22, 2002), respondent’s motion to dismiss, filed February 10, 2003, and motion to close case, filed February 27, 2003, are hereby granted and this case is dismissed for lack of jurisdiction. See Stallworth v. Moore, 827 So.2d 974
(Fla. 2002). All other pending motions are denied.
No motion for rehearing will be entertained by the Court.
