The uncontested referee’s report is approved and this Court’s order to show cause for indirect criminal contempt dated June 26, 2007, is hereby discharged as evidence shows that Macel Zambrano does not have the present ability to pay the restitution and monetary penalty assessed in this Court’s order dated September 20, 2006. Respondent shall pay restitution in the amount of $5,895.00 to Walter Salinas, and shall pay the $1,000.00 monetary penalty to this Court under the terms and conditions stated in the report.

Macel Zambrano is further directed to submit a written financial affidavit listing all assets and income to The Florida Bar, Unlicensed Practice of Law Division, 444 Brickell Avenue, Suite M-100, Miami, Florida 33131, beginning one month from the date of this order, and continuing every six months thereafter until all payments required by this Court’s order dated September 20, 2006, are paid in full.

Each party shall bear their own costs. The above-styled cause is hereby closed.
